Engineers and Agents as well as Civil servants of the Ministry in charge of Mines and other structures participating in mining governance, and particularly those under the command of Authorities responsible for Mines and Geology and the Inspector for Mines and Geology, Customs Agency, National Tax Department as well as departments under the Minister responsible for the Environment, are responsible, under the authority of the Minister in charge of Mines, to ensure the implementation of this Code and its implementing regulations, as well as the administrative and technical supervision of exploration,, operation and processing works of Mines and quarries and their appurtenances.
These Engineers, Civil servants and Agents referred to in this Article have the authority to exercise police powers for the preservation of buildings and ensure protection of Mining Titles and have the authority to act as permanent agents for monitoring marketing channels for precious substances from the production zones to the trading houses or to the borders for their export. They assist and advise operators on the disadvantages or improvements of their activities.
Orders of the Minister in charge of Mines and decrees issued on his recommendation set out the specific rules to be observed for certain mining or quarry works.
Executives and agents carrying out administrative and technical oversight duties must have a mission order issued by a competent authority, the duration of which is limited in time or officially designated to perform these functions by an instrument bearing the signature of the Minister in charge of Mines.
The National Mining Authority in partnership with the competent technical departments is responsible for health and environmental supervision. These operations may be unscheduled and unexpected in order to:
- ensure the effective implementation of the health adjustment plan referred to in Article 218 of this Code;
- assess the level of implementation and compliance with prior recommendations;
- amend the Plan if necessary;
- draw up a report to submit to the competent authorities indicating the degree to which the recommendations have been implemented.
