Article 137: Transport Rights

The holder of a Mining Title or Authorisation may, during the term of the Title and for six months thereafter, transport or cause to be transported production from which belong to it from the mining operations to storage, processing and loading sites.

With respect to export, the State reserves the right to transport fifty per cent (50%) of the production by sea. The State shall exercise this right, either directly or through any entity acting on its behalf.

The exercise and implementation of this right will be in accordance with international best practice. The right to transport may only be exercised under terms of pricing, delivery deadlines, safety, and insurance that are equivalent to those that would be offered by other service providers.

The exercise of this right will be notified in writing no later than the end of the first quarter of the relevant year, with respect to production of the following financial year.
