Article 114: Compensation

The holder of a Mining Title or Authorisation, operations whose are affected by measures taken or revoked under the preceding Article or by the revocation of such measures is to be compensated by the State for works that it is obliged to demolish and those which become useless, if they were built before the holder was notified of the order described in the preceding Article.

To obtain such compensation, the holder must submit a statement of expenses to the Mining Administration illustrating the expenses and costs it incurred in respect of the works that have been demolished or have become useless.

These expenses and costs will be assessed by an expert with a view to their approval by the Minister.
