Article 103: Legal Regimes

An order of the Minister responsible for Hydraulics sets out the conditions under which development of underground water should be considered small-scale and may be undertaken in derogation of the rules of this Code, in particular for drilling and the use of wells for domestic use.

The regimes defined for Mining by this Code and its implementing regulations, and for Hydraulics by the Water Code and its implementing regulations, apply, where relevant, to activities of exploration and development of geothermal deposits and underground waters to the extent that their provisions are not contrary to this Title and the provisions provided for its application.
