Article 9: Main Governance Structures of the Mining Sector

The governance of the mining sector is assured by the central and decentralized organs and services comprising the Mining Administration. These include notably:

  1. The National Geology Authority (La Direction Nationale de la Géologie);
  2. The National Mines Authority (La Direction Nationale des Mines);
  3. Le Bureau National d’Expertise des Diamants, Or et autres Matières Précieuses (BNE);
  4. The Mining Promotion and Development Centre (Le Centre de Promotion et de Développement Miniers (CPDM));
  5. The Study and Strategy Office (Bureau d’Etude et de Stratégie);
  6. The Precious Materials Anti Fraud Squad (La Brigade Anti-Fraude des Matières Précieuses);
  7. The Directorate General for Mining Projects Authority;
  8. The Inspectorate General for Mines and Geology;
  9. The Geo1Services Authority;
  10. The Managers and Assistant Managers of Mining Projects.

The powers, composition, organisation and operation of these departments are determined by decree of the President of the Republic.

A National Mining Commission is hereby established made up of representatives of the State and other components of the nation, in charge of participating, based on the provisions of the Mining Code, the examination of applications for the grant, renewal, transfer, extension and revocation of Mining Title.

Its powers, organization, composition and operation are determined by decree of the President of the Republic.

In the same way, a Technical Committee of Titles is hereby established as an internal committee of the Mining Administration, in charge of reviewing applications for the grant, renewal, continuation and extension, as well as files relating to the revocation of Mining Title prepared by the MPDC.
