All damage caused by the holder of a Mining Title Permit to landowners, usufructuaries and legitimate occupants of the land or to several successors, shall give rise to damages by payment of compensation referred to in Article 124 above.
In particular, where the owner, the usufructuary, or lawful occupant of the land or its successors have undertaken works or own facilities which would be rendered useless due to the mining operations, the holder shall reimburse them for the cost of these works or installations or, for their value on the date on which they become useless, whichever is lower.
Such compensation shall be offset, however, by any advantages that those suffering these damages may gain from the activity and work of the holder of the Mining Title.
