The holder of a Mining Title or Authorisation may, within the area of its Title or Authorisation, undertake works and activities, install facilities and construct buildings which are useful or ancillary to the implementation of exploration, or operation rights resulting from this Title or Authorisation. The holder nevertheless remains subject to compliance with the provisions of this Code, as well as those of the Forestry Code.
However, for the following activities, the holder must submit an application to the Minister in charge of Mines in order to obtain a specific Authorisation granted by order of the relevant Minister:
- Uprooting of all trees, shrubs and other obstacles, and logging necessary for the activities of the holder outside of boundaries of the holder’s property;
- Exploitation of unused and not reserved waterfalls and harnessing them for the holder’s activities;
- Setting-up facilities for the preparation, concentration or chemical or metallurgical treatment;
- Creation or improvement of roads, canals, pipelines, pipes, conveyors or other surface structures used to transport products outside the land owned by the holder;
- Creation and development of railways, sea or river ports and airports.
